PostHeaderIcon What Is Really Wrong With The Arizona & Obamacare Decisions?

I will not rehash the details of the two recent court rulings in question. Surely the media and the blogosphere have given you far more information than you need. My intent is simply to offer an opinion based on a point of view different from most of the analysis and opinion we have been subject to.

Most of that analysis and opinion has centered around the constitutionality of the two sets of laws – in both cases, are they consistent with the words and obvious intent of our Constitution and with the division of powers between the State and Federal governments?

Very powerful arguments can be made for either view, especially if one parses the sets of laws down to their most minute details.

I wish to opine that such details are not really important. That whether or not Arizona or Obamacare are totally in keeping with our Constitution is less important that a greater principle that is being violated in both cases.

The very essence of our Founding Documents and the system of government they spawned derives from a simple but vital notion: THAT WE HAVE A GOVERNMENT THAT GOVERNS BY THE CONSENT OF THE GOVERNED!

Regarding both court cases, a very clear and constant majority of those affected by these cases DO NOT give their consent and they have made this as clear as can possibly be made.

And, as should be clear to all without my saying it, a government that governs AGAINST the will of its people has become a tyranny. Period, no other explanation possible!

You may respond that all we need to do is vote out those people in the legislative and executive branches that have brought us to this. I respond that it simply is not that easy. The power of incumbency is such that the wholesale removal of scoundrels is becoming next to impossible (as I fear we are about to learn the hard way in the present presidential contest). In many precincts in our Republic, the takers outnumber (and out vote) the makers. What I mean by this is that the “vote” in this Republic has fallen into the greedy hands of those who would suck the very life-blood out of the Republic without the least concern for liberty, for future generations, or for the very survival of the Republic.

Is there then any alternative? There is and it is neither pretty or inviting to comprehend. The makers MUST band together and fight. By protests that clog the gears of government, by acts of civil disobedience, and, should it come to that (and I am certain it will) by acts of physical violence.

Yes, my friends, as has always been true, tyranny ultimately yields only to the gun and the sword, however much we wish it were not true, however much we wish there were another way that did not require the shedding of blood and the destruction of property. But, if you agree with me, and with millions who have gone before, LIBERTY is always worth the price because, with Liberty, all is possible, without Liberty, there is only misery.

I leave you with two thoughts from what I believe was the greatest mind among our Founders, Thomas Jefferson:

The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government.

God forbid we should ever be twenty years without such a rebellion. The people cannot be all, and always, well informed. The part which is wrong will be discontented, in proportion to the importance of the facts they misconceive. If they remain quiet under such misconceptions, it is lethargy, the forerunner of death to the public liberty…. And what country can preserve its liberties, if its rulers are not warned from time to time, that this people preserve the spirit of resistance? Let them take arms. The remedy is to set them right as to the facts, pardon and pacify them. What signify a few lives lost in a century or two? The tree of liberty must be refreshed from time to time, with the blood of patriots and tyrants. It is its natural manure.

Obviously, much more than twenty years have passed without the people reasserting their primacy. A few more years and it will be too late.

Think about it.

    The Civil War certainly provided a lot of natural manure and constituted more than a few lives lost in a century or two. Certainly civil disobedience a la MLK and Gandhi would be preferable. Any movement to be effective must have clear and morally understandable goals. Otherwise you are in for a real bloodbath.
