There is little doubt that at least one domestic terrorist has been active in Oxford, NC this year:

Sixteen-year-old Ashton Lundeby’s bedroom in his mother’s Granville County home is nothing, if not patriotic. Images of American flags are everywhere – on the bed, on the floor, on the wall.

But according to the United States government, the tenth-grade home-schooler is being held on a criminal complaint that he made a bomb threat from his home on the night of Feb. 15.The family was at a church function that night, his mother, Annette Lundeby, said.

“Undoubtedly, they were given false information, or they would not have had 12 agents in my house with a widow and two children and three cats,” Lundeby said.

Around 10 p.m. on March 5, Lundeby said, armed FBI agents along with three local law enforcement officers stormed her home looking for her son. They handcuffed him and presented her with a search warrant.

“I was terrified,” Lundeby’s mother said. “There were guns, and I don’t allow guns around my children. I don’t believe in guns.”

Ashton now sits in a juvenile facility in South Bend, Ind. His mother has had little access to him since his arrest. She has gone to her state representatives as well as attorneys, seeking assistance, but, she said, there is nothing she can do.

Lundeby said the USA Patriot Act stripped her son of his due process rights.

“We have no rights under the Patriot Act to even defend them, because the Patriot Act basically supersedes the Constitution,” she said. “It wasn’t intended to drag your barely 16-year-old, 120-pound son out in the middle of the night on a charge that we can’t even defend.”

Critics of the statute say it threatens the most basic of liberties.

“There’s nothing a matter of public record,” Boyce said “All those normal rights are just suspended in the air.”

Because a federal judge issued a gag order in the case, the U.S. attorney in Indiana cannot comment on the case, nor can the FBI. The North Carolina Highway Patrol did confirm that officers assisted with the FBI operation at the Lundeby home on March 5.

“Never in my worst nightmare did I ever think that it would be my own government that I would have to protect my children from,” Lundeby said. “This is the United States, and I feel like I live in a third world country now.”

It is getting that way mam. The question is, was there a single domestic terrorist on Feb. 15th, who is now confined as an enemy combatant; or were there a dozen of them on Mar. 5th in jackboots? Since the kid has been locked up for two months reportedly without access to legal council, I’d like to believe that he is guilty of something – even if just a foolish prank – for my own sanity. Yet, I just cannot comprehend how they can get away without explaining themselves to her elected Representatives, at the very least.

In any case, what has happened to our criminal justice system? I would bet good money that a single detective could have just knocked on this mom’s door in broad daylight, and explained the complaint. Undoubtedly, she would have called her son out to explain himself and made him tell the officer the truth. Failing that, they could have served the search warrant; but if it had already been three weeks since the alleged offense, there was absolutely no excuse for the late night raid, no matter what.

Conservatives who tended to defend the Patriot Act, because they defended Bush, need to rethink their knee-jerk position. Perhaps the line about it only giving law enforcement tools they already had for drug cases, wasn’t so persuasive after all, folks. Think! â—„Daveâ–º

Oh well, when the facts change, I change my opinion. He’s not being held under the Patriot Act. His mom lied to the news who ran with the story.

  • I’m not giving the govt any benefit of the doubt on this one. The ‘they arrested him, so he must be guilty’ line of reasoning doesn’t sit well with me. I see the opposite; if they had anything on him, they would have charged him with it by now.

    Wow, at this point it doesn’t really matter, a child really, at that age to be taken into custody in such a manner, then kept form legal council, never mind family, his widowed mother at that, he is destroyed for life. Even if he was a cop show junkie or an overly bright kid who studied the criminal justice system he doesn’t strand a chance being interrogated, locked up in who knows what condition, under what sort of questioning and stress, and being told what hsi rights are not and what they can do to him? At this point he would say and confess to anything. So in the end innocent or not(not being at worst a prank threat) he is looking at having his life F%&ked! I mean I have studied Criminology in College, along with Sociology both of the criminal mind as well as early childhood education(interesting irony’s there). Also, in the pursuit of my criminology studies also going through and recieving my P.O.S.T. certification. (Police Officers Standard of Training) With that in my background, it is amazing at how much I ahve to be on top of it and read between the lines when ever confronted by law enforcement. It is always to the effect of them trying to reassure me that they are my friends and only trying to help and if I jsut allow them to step all over my rights that it will all b e ok. RIght? And I am not a bad guy I am talking about simple things like being pulled over in a speed trap, or being the one to speak to the officers when they arrive at a get together or things like that. I see how their interview techniwues have even changed since my POST certification days. It is so tricky how they word things, always trying to get you to cricumvent your rights so they can walk over you Learn your rights and the important laws, Search and Seizure being very important as well as not speaking until a lawyer is present as you don’t want to incriminate yourself. Why do yo think the first thing they ask when you get pulled over for a traffic violation is,” Sir, do you know what I pulled you over for?” If you answer with a guess or whatever you think they pulled you for, BAMM, you just gave up your right to take the fifth! You voluntarily started giving them information and they can now legally follow up on that info. On top of that, you might admit to something they were not even pulling you over for. What should you answer to that question be, one might ask?? Simple, answer their question with a question…” Do you know what I pulled yo over for today?” ” No sir, Actually, I was about to ask you that question? (Said with an innocent expression and humble voice? Let them feel powerful, that is what they are looking for from you; Respect the badge, means respect for the LAW.) If you are really good you could finish it off with a,” I thought maybe I had a flat or a broken tail light? ( Then again, you might and get an other ticket. KISS it then.(Keep It Simple Stupid). Okay, Okay, I know, off on another tangent. I will get off my soap box and go home now. Thanks for letting me vent it is very cath-ar-itic(Spelling, is that even a word?_) for me. I will leave you with this, Does anybody remember when the police cars used to say, “to protect and serve…” on the side? Usually the rear quarter panel? I noticed this about three years ago, you started to not see that, in fact, I have not seen a ciop car with that saying on it in over 4 years+. Why would they take that off? What do they want to say?”to harrass and intimidate…” Come to think of it, kit is hard to see cop cars at all anymore! No not because there are less and less, there are actually more and more but they word so hard to make them not look like cop cars, hidden lights and sirens, the word POLICE really small or even changed to Public Safety Officer (You would think at least the Public Safety Officer would want us to know he was there to “Protect and Serve…” Wouldn’t you? Peace to all you patriots out there, and here. Keep your guns clean, your aim sharp and with the scarcity of ammo these days, don’t shoot till you see the whites of their eyes! (The Treasonous bad guys that is. I don’t want to make any idle threats, I need to get some sleep and don’t need a gang of JackBoots breaking in and disturbing my sleep in the middle of the night. Don’t mind the trip wires on the way in boys, 🙂

  • On protecting and serving: My guess is that they got tired of having everyone ask how they were protecting and serving with all the crap they are enforcing. The ratio of protecting and serving/revenue gathering seems to decline daily.

  • Thanks for the update and the link, John. It is a bit of a relief, actually. It was also encouraging to hear that the outrage was not along partisan lines for a change. I fault that local news station for not fact checking the story before they ran it. â—„Daveâ–º

    I figure it was the least I could do Dave. I fell for it, bit the hook etc.

    Like I said to some of my friends, if the facts were as the first article portrayed, the outrage shouldn’t fall along party lines. Everyone should be angered.

    However, like you, I’m glad to find that there was some basis for the charges, he has been charged, and likely, had it coming to him.
